In a significant legal development in Bareilly, Uttar Pradesh, a woman has been handed a sentence equal to the duration spent by a man she falsely accused of raping her daughter. The ruling, delivered by Additional Sessions Judge Gyanendra Tripathi, aims to underscore the seriousness of misusing the legal system.
The case traces back to December 2, 2019, when the woman, residing in the Baradari area, alleged that a man named Ajay alias Raghav had enticed her 15-year-old daughter to Delhi, where he supposedly drugged and assaulted her. Following her complaint, Ajay was arrested and spent a total of 1,653 days behind bars.
However, during court proceedings, a dramatic twist unfolded when the daughter retracted her initial statement. She clarified that Ajay had neither harmed her nor taken her to Delhi, ultimately leading to Ajay’s acquittal.
Subsequently, Ajay filed a complaint against the woman for misleading the court with false accusations. In response, the court imposed a sentence on the woman equal to the duration of Ajay’s incarceration, aiming to emphasize the gravity of her actions. Additionally, she was fined Rs 5,88,822, with the provision of an additional six-month sentence in case of non-payment.
Government advocate Sunil Pandey provided insights into the case’s progression and the initial allegations made by the woman. He highlighted the pivotal moment when the daughter’s testimony was retracted, leading to a reassessment of the situation and subsequent legal actions.
Judge Tripathi, in his ruling, emphasized the severity of false accusations, noting that they could have potentially resulted in a life sentence for Ajay.
